These Terms apply to the following Appalex apps:

Exception — Wordy: The Wordy language-learning app is governed by separate Terms of Service at wordy.info/terms. These Terms do not apply to Wordy.

About These Terms

These Terms of Service (“Terms”) govern your use of the Appalex apps listed above (collectively, the “Apps”), provided by Appalex Limited. By downloading, installing, or using any of the Apps, you agree to be bound by these Terms. If you do not agree, please do not use the Apps.

1. Eligibility

You must be at least 12 years old to use the Apps. By using an App, you represent and warrant that you meet this requirement.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Apps for personal, non-commercial purposes on devices you own or control.

Some Apps offer in-app purchases or subscriptions. The following terms apply only to those Apps.

3.1. Payment Processing

All payments are processed exclusively through the Apple App Store (iOS) or Google Play (Android). Current prices are displayed in the App and the relevant store.

3.2. Auto-Renewal

Subscriptions automatically renew unless cancelled before the next billing cycle. To cancel:

All purchases are subject to the refund policy of the platform where the purchase was made:

We cannot directly process refunds for App Store or Google Play purchases.

5.1. Our Content

All content, features, and functionality of the Apps — including text, graphics, logos, images, code, and design — are owned by Appalex Limited or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2. Third-Party Content

Where the Apps include third-party content (e.g., reference images, transit data, plant or card identification data), such content remains the property of its respective owners. We provide access for the purpose of operating the App.

5.3. User Content

If you create or save content within an App (e.g., photos you take, favorites you mark), you retain ownership. You grant us a limited license to store and process that content as necessary to provide the App’s features.

We strive for continuous availability but do not guarantee uninterrupted service. We are not liable for:

While we strive for accuracy, we do not guarantee that all content is error-free or fit for any particular purpose. This is especially relevant for Apps that provide identification (e.g., Tree Identifier), informational content (e.g., Fun Facts), or transit information (e.g., Hungary Public Transit) — results should not be relied on for safety-critical, medical, legal, or financial decisions.

7.3. Limitation of Liability

To the maximum extent permitted by law, our liability is limited to the amount you paid for the relevant App in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Your use of the Apps is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Modifications to Apps and Terms

9.1. App Changes

We may add, modify, or remove features at any time. We will notify you of significant changes through the App or via the relevant App Store update notes.

11.3. Governing Law

These Terms are governed by the laws of Hungary, without regard to its conflict of law provisions. This choice of law does not prevent you from relying on mandatory consumer protection laws in your country of residence.

11.4. Jurisdiction

For disputes that cannot be resolved through alternative dispute resolution, the courts of Budapest, Hungary shall have jurisdiction, subject to applicable consumer protection laws that may grant you the right to bring proceedings in your country of residence.

12. Miscellaneous

12.1. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Appalex Limited regarding your use of the Apps.

12.2. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

12.3. No Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

12.4. Assignment

You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
